Unless the District Court orders otherwise, interest is payable on the judgment debt - see section 101 of the Civil Procedure Act 2005. Practitioners will note, however, that the judgment debtor has 28 days from the date of judgment, or the effective date of judgment, to pay the debt in full without incurring interest. Interest may be claimed on any unpaid part of the judgment debt thereafter. Interest may also be claimed on an Order for costs - see section 101(4) of the CPA 2005.

The District Court may determine the rate of post judgment interest or Order interest to be paid at the prescribed rate. The prescribed rate refers to the rate of interest prescribed by the Uniform Civil Procedure Rules 2005. Netlaw's District Court Interest Rate Calculator calculates post judgment interest at the rate prescribed by Regulation 36.7 of the Uniform Civil Procedure Rules 2005.

Practitioners should refer to the Act and the Rules, together with any other relevant legislation and Court Practice Notes as Netlaw makes no promises, warranty, statement or guarantee as to the accuracy of information provided on this website and does not purport to provide legal advice.
